No failure or delay on the part of Viajes Disney in exercising any right or remedy hereunder or enforcing the terms and conditions of this agreement will operate as a waiver thereof. If any part or provision of this agreement is found to be invalid, unenforceable or void, then the remaining portion shall remain in full force and effect. Headings are for convenience only and not for use in interpretation of this agreement.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Viajes Disney as a result of this agreement or use of this web site.

Any rights not expressly granted herein are reserved.

TERMINATION

Viajes Disney may immediately terminate any or all of your rights of use if you breach any of these Terms of Use, or if Viajes Disney is unable to verify or authenticate any information you provide to us, or for any other reason in our sole and absolute discretion. In the event of termination, you will remove all references to this site and Viajes Disney including the link and logo link, in any, within twenty-four hours of written request by Viajes Disney.

Todos los Paquetes Turísticos que figuran en el catálogo Cruises y/o en su página web oficial se ofrecen a la venta por Cruises ., en adelante la “Compañía”. En los Términos y Condiciones de Reserva las siguientes expresiones tendrán el significado que se les asigna a continuación:

Por “Reserva” se entenderá los trámites realizados por el Pasajero para formalizar un Contrato con la Compañía. 

Por “Términos y Condiciones de Reserva” se entenderán estos términos y condiciones que se recogen en el catálogo de la Compañía, la Página Web oficial y/u otra información que formará parte de los términos expresos de su Contrato con la Compañía. 

Por “Transportista” se entenderá la entidad que ha asumido la obligación de transportar al Pasajero de un lugar a otro según se indica en el billete del Crucero, billete de avión o cualquier otro billete emitido para cualquier otro transporte aplicable y que por esta razón aparezca indicado en dichos documentos como “transportista”. El término “transportista” incluye al propietario, fletador u operador y sus servidores o agentes de cualquier proveedor de transportes. 

Por “Compañía” se entenderá a Cruises ., cuyo domicilio social se encuentra en Miami, Florida 33330 y que organiza Paquetes Turísticos y los vende o los ofrece en venta, ya sea directamente, a través de su página web, o bien a través de sus Agentes de viajes. 

Por “Condiciones de transporte” se entenderá las condiciones y términos bajo las cuales el Transportista proporcione o ejecute el transporte ya sea por vía aérea, terrestre o marítima. Las Condiciones de transporte pueden referirse a las disposiciones de la legislación del país del Transportista o a convenios internacionales, que pueden limitar o excluir la responsabilidad civil del Transportista. Se encuentran a disposición de los Pasajeros que lo soliciten copias de las Condiciones de transporte de cualquier Transportista. 

Por “Contrato” se entenderá el contrato formalizado entre la Compañía y el Pasajero, relativo al Paquete Turístico correspondiente, acreditado por la emisión de la confirmación de Reserva emitida y enviada al Pasajero por la Compañía o por una Agencia de Viajes. 

Por “Crucero” se entenderá el transporte por mar y la estancia a bordo de un barco de la flota de Cruises (según descrito en el catálogo oficial de la Compañía, en la página web oficial de la Compañía o bien en otra documentación elaborada por o en nombre de la Compañía), por lo que – si no se reserva con Ser vicios pre o post Crucero – puede ser considerado como un Paquete Turístico en sí mismo. En caso de discrepancia entre lo descrito en el catálogo de la Compañía o en la página web, en la documentación facilitada por terceros y/o en la confirmación de reserva, prevalecerá la información contenida en el catálogo de la compañía y/o en la página web y/o en la confirmación de reserva. La Compañía no será responsable de la información incorrecta facilitada por terceros ajenos a la Compañía. 

Por “Pasajero con Discapacidad” o “Pasajero con movilidad reducida” se entenderá cualquier Pasajero cuya movilidad para utilizar transportes sea reducida como consecuencia de una discapacidad o deficiencia física (sensorial o locomotora, permanente o temporal), intelectual o psicosocial, o cualquier otra causa de discapacidad o deficiencia, o como consecuencia de la edad, y cuya situación requiera una atención especial y adaptación a sus necesidades particulares de los ser vicios ofrecidos a todos los Pasajeros. 

Por “circunstancias inevitables y extraordinarias” se entenderá cualquier suceso imprevisible e impredecible que escapa del control del Transportista o de la Compañía, incluyendo ac tos de la naturaleza como, entre otros, inundación, terremoto, tormenta, huracán u otros desastres naturales, guerra, invasión, acción de enemigos extranjeros, hostilidades (independientemente de que se haya declarado o no la guerra), guerra civil, rebeliones, revolución, insurrección, usurpación o confiscación del poder, golpe militar, actividades terroristas, riesgos de salud, nacionalización, sanción gubernamental, bloqueo, embargo, conflicto laboral, huelga, cierre patronal, interrupción o avería del ser vicio eléctrico o de telefonía o cualquier problema técnico con el transporte, incluyendo cambios debido a la recolocación o cancelación o modificación de vuelos, congestión o cierre de aeropuertos o puertos. 

Por “Crucero Combo” se entenderá la combinación de dos o más cruceros concertados por la compañía y ofrecidos en venta como un único Viaje Combinado. Para cualquier propósito relevante, el Crucero Combo se considerará siempre como un único e indivisible Viaje Combinado. Todos los términos y referencias a un crucero y/o a un Viaje Combinado incluirán y serán igualmente aplicables al Crucero Combo salvo pacto en contrario. Las referencias al precio son referencia al precio total pagado por el Crucero Combo. 

Por “Página web oficial” se entiende el conjunto de las páginas web, los documentos y la estructura de hipertexto accesibles desde la dirección cruceros.es. 

Por “Viaje combinado” se entenderá el Crucero con o sin vuelos incluidos y/o cualquier servicio pre y/o post crucero. No incluye excursiones en tierra ni servicios de enlace que no formen parte del precio total del Viaje Combinado. 

Por “Pasajero” se entenderá cada una de las personas, incluyendo menores, identificadas en la confirmación de la Reserva, en la factura o en un billete emitido por la Compañía. 

Por “Agente de ventas” se entenderá la persona o agencia de viajes que venda u ofrezca en venta el Viaje Combinado organizado por la propia Compañía o en representación de la misma. 

Por “Excursión” se entenderá cualquier recorrido o actividad en tierra que no esté incluida como parte del precio del Viaje Combinado y que la Compañía ofrezca en venta: 

• A través de una agencia de viajes

• A bordo de sus barcos

• A través de la página web oficial cruceros.es

• A través del Call Center (solo aplicable para venta directa a través de cruceros.es) 

Por “ World Cruise” se entenderá el recorrido por el mundo, fijado por la Compañía y ofrecido en venta como un único Viaje Combinado. Para cualquier propósito, World Cruise se considerará siempre como un Viaje Combinado único e indivisible. Todos los términos y referencias a un Crucero y/o Viaje Combinado se incluirán y serán igualmente aplicables a World Cruise, a menos que se prevea lo contrario. Las referencias al precio son referencias al precio total pagado por World Cruise.
